1. Acceptance of Terms

By downloading, accessing, or using Viewra AI ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

2. Description of Service

Viewra AI is an AI-powered photo transformation application that allows users to:

• Transform photos using AI-generated prompts and styles
• Create custom AI transformations through our AI Studio
• Save and share transformed images
• Purchase credits for image transformations

3. User Accounts

To use certain features of the App, you must create an account. You agree to:

• Provide accurate and complete information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access
• Accept responsibility for all activities under your account

4. Credits and Payments

4.1 Credit System

The App uses a credit-based system for AI transformations. Each transformation costs credits as indicated in the App.

4.2 Purchases

• All purchases are processed through the Apple App Store or Google Play Store
• Prices are displayed in your local currency
• Credits are non-transferable between accounts

4.3 Refunds

Refund requests are handled according to Apple App Store and Google Play Store policies. Used credits are generally non-refundable. For billing issues, contact the respective app store or our support team.

5. User Content and Conduct

5.1 Your Content

You retain ownership of photos you upload. By using our service, you grant us a limited license to process your photos for the purpose of providing AI transformations.

5.2 Prohibited Content

You agree NOT to upload or generate content that:

• Is illegal, harmful, threatening, abusive, or harassing
• Contains nudity, sexually explicit material, or pornography
• Depicts violence, gore, or promotes harm to others
• Infringes on intellectual property rights of others
• Contains personal information of others without consent
• Is discriminatory based on race, gender, religion, or other protected characteristics
• Attempts to deceive or create deepfakes for malicious purposes
• Violates any applicable laws or regulations

5.3 Content Moderation

We reserve the right to review, remove, or refuse to process any content that violates these Terms. Repeated violations may result in account termination.

6. Intellectual Property

6.1 Our Property

The App, including its design, features, code, and AI models, is owned by Viewra AI and protected by intellectual property laws.

6.2 Generated Images

Images you generate using our AI tools are yours to use, subject to these Terms. However:

• You may not claim the AI technology itself as your own
• Commercial use of generated images is permitted for personal projects
• You are responsible for ensuring your use complies with applicable laws

7. Data Retention

Automatic Deletion: Generated images and chat sessions are automatically deleted from our servers after 7 days. Please save any images you wish to keep to your device before this period expires.

8. Disclaimers

8.1 AI Limitations

AI-generated content may not always be accurate, appropriate, or as expected. We do not guarantee specific results from any transformation.

8.2 Service Availability

THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. We do not guarantee uninterrupted or error-free service. We may modify, suspend, or discontinue features at any time.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, VIEWRA AI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

10. Indemnification

You agree to indemnify and hold harmless Viewra AI and its affiliates from any claims, damages, losses, or expenses arising from your use of the App or violation of these Terms.

11. Account Termination

We may terminate or suspend your account at any time for violations of these Terms. You may also delete your account at any time through the App settings or by contacting support.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of significant changes through the App or via email. Continued use of the App after changes constitutes acceptance of the new Terms.

13. Dispute Resolution and Arbitration

13.1 Informal Resolution

Before initiating any formal dispute resolution, you agree to first contact us at info@geminifyai.store and attempt to resolve the dispute informally for at least 30 days.

13.2 Binding Arbitration

If informal resolution fails, any dispute, claim, or controversy arising out of or relating to these Terms or the App shall be resolved by binding arbitration, rather than in court, except that you may assert claims in small claims court if your claims qualify.

The arbitration will be conducted by a neutral arbitrator in accordance with the rules of the American Arbitration Association (AAA) or similar arbitration body. The arbitration shall be conducted in English, and the arbitrator's decision shall be final and binding.

13.3 Class Action Waiver

YOU AND VIEWRA AI AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. Unless both you and Viewra AI agree otherwise, the arbitrator may not consolidate more than one person's claims and may not otherwise preside over any form of a representative or class proceeding.

13.4 Opt-Out

You may opt out of this arbitration agreement by sending written notice to legal@geminify.app within 30 days of first accepting these Terms. Your notice must include your name, email address, and a clear statement that you want to opt out of this arbitration agreement.

14. Export Compliance

You agree to comply with all applicable export and re-export control laws and regulations, including but not limited to:

• The Export Administration Regulations (EAR) maintained by the U.S. Department of Commerce
• Trade and economic sanctions maintained by the U.S. Treasury Department's Office of Foreign Assets Control (OFAC)
• The International Traffic in Arms Regulations (ITAR) maintained by the U.S. Department of State

You represent and warrant that you are not located in, under the control of, or a national or resident of any country to which the United States has embargoed goods or services, and that you are not on the U.S. Treasury Department's list of Specially Designated Nationals or the U.S. Commerce Department's Denied Persons List.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to conflict of law principles. Subject to the arbitration provisions above, any legal action or proceeding shall be brought exclusively in the federal or state courts located in Delaware.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.
